Sexual Abuse
Sexual nursing home abuse can be perpetrated by other residents, visitors or nursing home staff. Cases of sexual nursing home abuse may include sexual battery, sexual contact, rape, aggravated sexual assault, or gross sexual imposition.
Sexual nursing home abuse is the use, persuasion, inducement, enticement, or coercion of the victim to engage in sexually explicit conduct or simulation of such conduct. Sexual battery is an unwanted form of contact with an intimate part of the body—whether the victim is clothed or not—that is made for purposes of sexual arousal, gratification or abuse. Sexual contact is intentional touching, either directly or through the clothing, of the genitalia, anus, groin, breast, inner thigh, or buttocks.
Rape is generally defined as sexual intercourse by forcible compulsion or with a person who is incapable of consent, physically helpless or mentally incapacitated. Sodomy involves deviate sexual conduct, as opposed to intercourse. Sexual abuse involves similar elements of force or lack of consent, but involves contact rather than intercourse.
Aggravated sexual assault maims, wounds, or disfigures the victim, or involves a victim who is physically or mentally incapacitated. It may also include a sexual assault that is aided or abetted by another person, occurs during commission of another crime, or involves use of a deadly weapon.
Gross sexual imposition is governed by state laws. However, gross sexual imposition is typically defined as a sexual assault that involves force or threat of force, impaired judgment of the victim due to drugging, or the inability of the victim to consent due to impaired mental or physical condition or advanced age.
